Pollution Control Facility Committee

The DeKalb County Pollution Control Facility Committee met on November 20, 2009 @ 11:30a.m. In the Legislative Center's Gathertorium.  County Board Chairman, Ruth Anne Tobias, called the meeting to order.  Members present were Ken Andersen, Riley Oncken, Paul Stoddard, Pat Vary. Members absent were Mike Haines and Marlene Allen.  Staff present were Ray Bockman, John Farrell, Paul Miller, Bob Drake, Renee Cipriatti, Chris Burger.  Also present were Lee Addelman and Elena Grimm.  A quorum was present.

 

APPROVAL OF THE AGENDA

    Moved by Mr. Oncken, seconded by Mr. Andersen, and it was carried unanimously to approve the agenda as presented.

 

Everyone then introduced themselves to each other.

 

SELECTION OF ACTING CHAIRMAN

    Ms. Vary nominated Mr. Paul Stoddard as the Acting Chairman.  Mr. Andersen seconded this nomination. 

 

    Mr. Andersen closed the nomination and seconded by Mr. Oncken.

 

    It was unanimously approved to have Mr. Paul Stoddard as the Acting Chairman of the Pollution Control Facility Committee.  Mr. Stoddard abstained.

 

SELECTIONOF THE HEARING OFFICER

    Mr. Bockman, DeKalb County Administrator, asked the committee to please consider nominating Mr. John McCarthy as the Hearing Officer.  His resume has been distributed previously, he said

 

    Moved by Mr. Oncken, seconded by Ms. Vary, and it carried unanimously to nominate Mr. John McCarthy as the Hearing Officer. 

 

HEARING SCHEDULE/ATTENDANCE

    Mr. Bockman passed out the recommended public hearing schedule.  The hearings will begin March 1, 2010 from 9-5:00p.m with an hour and a half lunch break.  The public comment session will be held between 7-9:00p.m.on Tuesday evening.  If there are more people who need to comment after 9:00p.m., the comment period then will be continued over to Wednesday evening.  If the hearing is not finished by the end of business that Friday, they would propose to reconvene the next Wednesday since some of the committee members will be at a conference that weekend in Washington, D.C.  The committee discussed whether or not the hearings should be held in the Gathertorium or Kishwaukee College or another place. 

 

    Moved by Mr. Andersen, seconded by Ms. Vary, and it was carried unanimously to adopt the hearing schedule.

 

    The committee agreed to give some thought to a Plan B to move the public hearings from the Gathertorium to a larger venue. 

 

UPDATE ON APPLICATION/PREFILING REVIEW

    Mr. Lee Addelman said that their notices have gone out, publications in local newspapers are done.  The list of the number of paper and CD copies has been finalized and they are on schedule to meet that.   He said that Patrick Engineering has done a great job in reviewing their application so far.

 

    Mr. Paul Miller asked Mr. Addelman how many surrounding properties are we talking about?  Mr. Addelman said that we don't have a handle on that yet, but he feels about 17 properties actually touch and about the landfill property.  They have made contact with all of these property owners.  On the south side of the I-88 Tollway there are about 18 homes in the Montabalno Project. 

 

    Mr. Miller asked if the tollway would be notified about your project? 

 

    Mr. Addelman said that he didn't think so since they have no impact on their property and they have no jurisdiction.

 

    Ms. Cipriano said that she felt that Mr. Addelman should notify the Tollway.

 

DISCUSSION OF LEGAL ISSUES

    Ms. Renee Cipriano said that her next step would be to hold a discussion with Mr. John Farrell, DeKalb County State's Attorney about how he would like to approach the application once its filed and then they can handle issues at that point in time. 

 

    Going back to the size of our room to hold these hearings, Mr. Andersen did not feel that the size of the Gathertorium was big enough to hold the hearings. 

 

    Mr. Addelman said that if 300 people show up for the hearings we many need the multi-purpose room at the Health Facility Building since it can at least hold 250 people.  Some people discussed the fact that the Farm Bureau also has a large room that can hold 250 people.  They also discussed Kishwaukee College auditorium that can hold up to 300 people.  It was agreed to see if the County could hold the hearings at Kishwaukee College.

 

 

REPORT OF IEPA MEETING

    Mr. Ray Bockman said that he and Mr. Chris Burger of Patrick Engineering met with the IEPA staff and they stated that the application review can take up to 15 months to 2 years to complete.  They will continue to work with them.

 

    The committee agreed not to meet again until it is nearer to the public hearing dates.

 

    Mr. Addelman cautioned the committee that Waste Management can not talk to members of the County Board after the application is filed.  They will, though, attend our County Board meetings.

 

ADJOURNMENT

    Moved by Mr. Andersen, seconded by Mr. Oncken, and it was carried unanimously to adjourn the meeting.
